common questions

SELLING DURING PROBATE

How long does the probate process take?

Every probate case can vary depending on its size and issues.  An experienced probate attorney can provide a more accurate time frame, but most cases take more than 9 months, and sometimes years.

Can we sell the real property during probate?

Yes, selling the real property during the probate case allows the heirs to sell the property in "As-Is" condition with no warranties and no repairs made by the heirs to the buyer.  This provides more protection to the heirs from liability since the heirs are not expected to know much about the condition of the probate property.  The same is not true if the heirs choose to sell AFTER the probate case is over.

Should we sell the real property after probate?

It is an option to sell the real property after the probate case.  However, often times, the property has to be sold to satisfy creditors, to divide assets among the heirs, or because costs of maintenance and management of the property creates a burden to the family.  The Personal Representative should follow the advice of legal counsel.  (click here to see a list of trusted probate attorneys).

What do we have to do to the house to get it ready for market?

Especially true with probate, the condition of real property greatly varies.  Call or email Kurniadi Realty, and Jonathan Kurniadi will be pleased to meet you at the property and give you tailored suggestions on getting the house ready for market.

Is it a good time to sell?

Call or email Kurniadi Realty, and we can provide you a “no charge” market update of the local area and a Market Analysis of the probate real property.  (see our “Recently Solds” for market areas we have experience in)

HELP SELLING

What if neither I nor the family has the money to get the house ready for sale?

Often times, the estate does not have the funds to address major issues (i.e. mold remediation; junk hauling) or even, cosmetic issues (i.e. paint; yard cleanup).  On a case by case basis, Kurniadi Realty is able to advance funds necessary to clean, market, and sell the probate property.

I live far from the property and the estate.  Can you help sell the property remotely?

Yes, many of our clients live outside of the Bay Area or in other states.  We are committed to serving our out-of-town clients by preparing the probate property from the cleanout stage to the close of escrow of the sale.

I am overwhelmed with cleanup, selling the personal property, remediating/rehabbing, or simply painting.  Can you help with these tasks?

Yes, we provide full-service real estate.  (see "Full Service")  Simply put:  we Organize, Donate, Haul away, Clean, & Market probate property.  And there is no additional charge for these services
